Terms and Policies

On line orders:

PC Universe reserves the right to review all orders at which point we may accept or decline any order for any reason, regardless of any confirmation receipt sent to the customer. All orders must be reviewed for pre-approval and acceptance. We do our best to ship your order as quickly as possible. While there can be no guarantee, most in-stock orders placed before 3:00pm EST will ship the very same day. Orders placed after 3:00pm or on weekends or holidays are usually shipped the next business day. Cancellations can be made on any order that has NOT shipped, except for special order purchases. PC Universe is also NOT responsible for cancellation requests made after the product has shipped.

Shipping:

PC Universe retains ownership of all products until the point of payment has been received and product delivered, at which time ownership is given to the said customer. Shipping charges are applied to orders irrelevant to weight, size and destination of shipment. PC Universe does not currently ship US mail, therefore we are unable to deliver to PO, APO, and FPO box addresses. Also we do not export product, we only do business in the United States of America. PC Universe reserves the right to choose the shipping carrier.

Freight Policy:

Our product availability is subject to change due to our high volume of sales. If a product is not in stock you will receive an email within one business day. If you need status sooner please feel free to call our Customer Service line between the hours of 9am and 6pm Eastern Standard Time Monday through Friday.

Shipping charges will vary depending on the size and weight of order.

At PC Universe, we strive to make returning products easy and efficient, provided certain guidelines are followed. Please review our return policies before requesting an RMA. Should you have any questions or comments regarding these policies, please feel free to contact Customer Service at (877) 873-7155.

Return Guidelines

While PC Universe strives to achieve superior customer service, we can NOT guarantee a return for every item. In most cases, opened non-defective products are non-returnable. Please ensure that the product you are interested in not only suits your needs, but is compatibile with any existing hardware and/or software you wish to use with it. For specific product return guidelines, please contact PC Universe Customer Service prior to ordering.

Shipping charges are non-refundable.

Special Order items are non-returnable.

All exchanges and returns require a Return Merchandise Authorization (RMA) number.

An RMA must be requested within 15 days of the original invoice date. Thereafter, all sales are final.

The returned package must be received within 10 business days of the RMA issue date.

All products are sold with their respective manufacturer's warranties. Please note that warranty periods and services vary by manufacturer and product.

When returning products, we strongly recommend the use of a carrier that can track packages. You also assume responsibility for insuring the returned item.

All returns, with the exception of a defective exchange, are subject to a 15% Restocking Fee.

All items must be returned in "as new" condition in the original packaging and include all accessories, blank warranty cards, UPC codes (attached), and user manuals. If an item is returned with missing contents, the RMA will either be revoked, or a 25% restocking fee will be applied at PC Universe's discretion.

Defective items can be exchanged for the same item ONLY.

PC Universe will not recommend items due to compatibility issues. Any item returned to PC Universe due to a compatibility issue will automatically receive a 15% Restocking Fee. Please be sure that the item you are purchasing is compatible prior to checkout.

All Opened Non-Defective returns are subject to a 15% restocking fee.

Opened software will not be accepted for return.

Items Damaged in Transit

Should an item appear to be damaged in transit, please refuse delivery and contact PC Universe as soon as possible. We will issue an RMA immediately, and ship you a replacement product right away. If you are unable to refuse delivery of a damaged product, please follow one of the following return request methods.

Requesting A Product Return

Feel free to select one of the following ways to request a return:

1. Send your request via email to customerservice@pcuniverse.com. Please include your order number.
2. You may contact Customer Service at 877-873-7155 from 9AM to 5PM, Monday through Friday, Eastern time.

After Receiving Your Return Merchandise Authorization (RMA) Number

Write your RMA number legibly on the return label.

Do not write on the original packaging. Packages without an AUTHORIZED PCU RMA number will be refused back to the sender.

PC Universe cannot accept returns from the following manufacturers for FOR ANY REASON:

• Kodak
• Compaq
• IBM
• Toshiba
• Hewlett-Packard
• Canon
• Sony
• Minolta/QMS

Please call our Customer Service for the specific terms of the manufacturer of your product.

PC Universe reserves the right to add manufacturers to this list without prior notice.

OFFICIAL RULES. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL U.S. RESIDENTS 18 YEARS OF AGE OR OLDER. OFFERED ONLY IN THE UNITED STATES.

1. PROMOTION PERIOD: The promotion period begins December 29, 2003 at 12:01am est. and ends at 11:59pm est. on March 1st, 2004.

2. HOW TO ENTER: You may enter in one of two ways. (1) During the Promotion Period, complete the online entry form at https://www.pcuniverse.com/new_account.asp and click the "continue" button. Entrants must provide all information requested on the online entry form to be eligible. Incomplete entries are void. There is no purchase necessary to enter via this method. OR (2) Persons placing valid orders for merchandise from http://www.pcuniverse.com during the Promotion Period are automatically entered. You will receive only one entry, regardless of the number of purchases you make. Only one entry per person, household or email address per day. Any attempt by an entrant to enter more than once per day will result in disqualification of all entries submitted by that entrant. Entries become the property of PC Universe, Inc. and will not be returned. Entrants will receive emails and marketing materials from PC Universe about special promotions and product offers. To decline such notifications, follow the opt-out instructions in any email received.

3. DRAWING AND AWARDING OF PRIZE: A random drawing will be conducted from all eligible entries received during the Promotion Period to determine the winner of the prize. The drawing will be held on the Thursday of each week with the winner being announced the following day. All drawings are conducted under the supervision of PC Universe, Inc whose decisions are final in all matters relating to this promotion. Odds of winning depend on the total number of eligible entries received.

4. PRIZE: Upon verification of eligibility, one (1) prize winner will receive a Canon S200 color printer. The winner must take delivery of the device from PC Universe within thirty (30) days after receiving notice of award, or the prize may be forfeited and awarded to an alternate winner. Acceptance of the prize constitutes permission for PC Universe and its agents to use the winner's name, likeness, photo, voice, and biographical information for promotional purposes in television, radio, Internet, and print advertisement without further compensation or notice, except where prohibited. No substitution, cash equivalent or transfer of the prize is permitted except at the sole discretion of PC Universe, who reserves the right to substitute a prize of equal or greater value in the event the prize is unavailable for any reason. Winners are responsible for payment of all taxes on the prize and for any other expenses associated with the prize not specifically described herein. In the event of a dispute as to the identity of a winner, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry if the entry was made without purchase or the authorized account holder of the credit card used to make the purchase if entry was made wit purchase. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) That is responsible for assigning email addresses for the domain associated with the submitted email address. The use of any device to automate the entry process is prohibited.

5. ELIGIBILITY: Promotion open to all legal U.S. residents (excluding residents of Puerto Rico, Hawaii, or Alaska) who are 18 years or older as of November 1, 2003. Employees of PC Universe, or its respective subsidiaries, affiliates, and advertising and promotion agencies and their immediate families (defined as current spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible. Void where prohibited or restricted by law. Promotion subject to all applicable federal, state and local laws and regulations. By participating, entrants agree to be bound by these official rules and to accept the decisions of PC Universe as final in all matters relating to this promotion.

6. NOTIFICATION: Winner will be notified via e-mail, phone, and/or U.S. mail and may be required to complete and sign an Affidavit of Eligibility/Liability Release and, where legal, a Publicity Release, which must be returned, properly executed, within fourteen (14) days of issuance of prize notification. If these documents are not returned within this time period, or the notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. Limitation of Liability: By participating in the promotion, entrants agree that PC Universe, and its respective parent companies, affiliate and subsidiary companies, advertising and promotions agencies, and all of their agents, directors, officers, representatives, shareholders and employees will have no liability whatsoever for (i) any injuries, death, losses, or damages of any kind resulting from participation in the promotion or acceptance, possession or use of any prize that may be awarded. PC Universe is not responsible for printing or typographical errors in any promotion-related materials, or for stolen, lost, late, misdirected, damaged, incomplete or illegible entries. If PC Universe determines, in its sole discretion, that there is any suspected or actual electronic tampering with the promotion, or if technical difficulties compromise the integrity of the promotion, PC Universe, in its sole discretion, reserves the right to void any entries submitted fraudulently or cancel or modify the promotion. Any deliberate attempt by an entrant or any other individual to damage any web site or undermine the legitimate operation of promotion is a violation of criminal and civil laws and should such an attempt be made, PC Universe reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. PC Universe, and its affiliates, subsidiaries, advertising and promotion agencies, and Internet access providers are not responsible for incorrect entry of information by entrants, or technical malfunctions of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, human error, or lost/delayed data transmission; or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction.

Crediting Your Account

Credit will be issued within two business days of receiving your return. All refunds for credit will be issued to the credit card account that appears on the original invoice. Shipping and handling fees are non-refundable. Please note that your financial institution may take up to 10 additional days from the date we issue the credit to post it to your actual account. Questions regarding this should be directed to your financial institution. When returning an item paid for by check or money order, a refund check will be mailed to you within 10 business days from the time we receive your return.

Pricing Policy:

PC Universe will do everything to keep our prices competitive with our competition so you will feel confident doing business with us, and that you are getting the product for THE best price. With regards to typographical errors or errors in pricing, we reserve the right to refuse to sell a product to a customer at a price on our site that may be priced wrong.

Legal Disclaimer:

PC Universe hereby expressly disclaims all warranties either expressed or implied warranty of merchantability or fitness for a particular purpose. This disclaimer by PC Universe in no way affects the terms of the manufacturer’s warranty, if any. Title to goods herein being purchased is retained by the sellers until goods are paid for by the purchaser and at that time title passes to the purchaser. This Site operates AS-IS and AS-AVAILABLE, without liability of any kind. We are not responsible for events beyond our direct control. This Policy is governed by Florida law, excluding conflicts of law principles. Any legal actions against us must be commenced in Florida within one year after the claim arose, or be barred.
